The court heard that an Improvement Notice was served by the HSE to The Shower Tray Company Limited in September 2015 due to the lack of edge protection in their storage area.
Failing to Meet Obligations
A mezzanine floor above some ground floor rooms was being used for storage. This regularly required employees to access the area which led to them effectively working at height. However, the company had failed to meet their obligations to provide edge protection. This lack of edge protection meant there was no means to prevent a fall from height. The missing fall protection was picked up on an inspection which led to the Improvement Notice being issued.
The Shower Tray Company Limited were fined £16,500 plus costs for breaching Section 2(1) of the Health and Safety at Work etc. Act 1974 and Section 33 of the same for failing to comply with the Improvement Notice.
